DON KRC Fine Food PROMOTION 2024 – TERMS AND CONDITIONS

Information on how to enter and the prizes form part of these Terms and Conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.

Eligible Entrants

Entry is open to residents of Australia

Entrants who are under the age of 18 must seek permission from their parent or guardian to enter.

Employees and management (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

How to Enter

To enter, each entrant must, during the Entry Period: 

  1. Be a ticketed attendee of the ‘Fine Food Australia’ event, taking place at the Melbourne Convention & Exhibition Centre (“Event”);

  2. For entry into the Giant Hookey Game Instant Prize:
    1. Visit the DON KRC stand Z29 at Fine foods during the Promotional Period. 
    2. You must then follow the representative’s instructions on how to play the hookey board game (while stocks of prizes last). 
    3. The giant hookey game will operate as follows: 
      1. Entrants will have three (3) attempts at throwing a ring onto the giant hookey board (from the location marked by promotional staff);
      2. Entrants that achieve a score over 30 points (from all three throw attempts combined) will receive a prize, as outlined below (with prizes allocated on a ‘first come first served basis’, while stocks last).
    4. Entrants will then be notified immediately as to which, if any, instant prize they have won and how to redeem it.

c. For entry into the Prize Draw (Optional)

  1. Visit the DON KRC stand Z29 at Fine foods during the Promotional Period
  2. scan the QR code to visit [https://donkrcfoodservice.com.au/fine-food and fully complete the online entry form, including [full name, mobile number, email address, job description] and submit a response to the following questions:

-Type of establishment / business

-Size of establishment / business

-Who is your preferred distributor?

-Do you decide what goes on the menu? If no who does?

-Do you think you can use any of the COOKT products on your menu?

-If yes, please specify the product/s you would be most interest in. 

iii. Or engage with an attendee at the Don KRC stand and scan their personal attendance QR code to share their details (as collected during the registration process) with the Promoter.      



Limits on Entry

  1. Limit one (1) attempt at the giant hookey game permitted per person; and 
  2. Limit One (1) prize draw entry permitted per person.  

Entries which in the reasonable opinion of the Promoter: (a) are received outside the Promotional Period; (b) contain defamatory, offensive or inappropriate content or infringe intellectual property rights; (c) are incomplete or indecipherable; or (d) do not otherwise comply with these terms, will be invalid and ineligible for any prize. 

Entry Period

The Promotion commences at [10.00 AM] [AEST] on [02/09/24] and ends at [3 PM] [AEST] on [05/09/24] (“Entry Period”). 

Selection of Winners

The Giant Hookey game: 

  • Entrants will have three (3) attempts at throwing a ring onto the giant hockey board (from the location marked by promotional staff);
  • Entrants that achieve a score over 30 points (from all three throw attempts combined) will receive a prize, as outlined below (with prizes allocated on a ‘first come first served basis’, while stocks last).

Draw Prize: The winner(s) will be selected by an approved computerised random system.

If an entrant acts in a disorderly manner, attempts to skip their position in the queue, or is physically or verbally abusive or disruptive to the peaceful implementation of the game, they may be asked to leave by the Promoter’s representative and will forfeit their chance to participate in the game and to win a prize.

The total prize pool for both the Draw Prize and the Giant Hookey Game is $10,850, All prize values are correct as at 27/08/24 and are in Australian Dollars, but to the extent permitted by law, no responsibility is accepted by the Promoter for any variation in the value of the prize after that time.

Prize Limitations

For the Draw Prize: Any ancillary costs associated with redeeming the visa e-gift card are not included. Any unused balance of the gift card will not be awarded as cash. Redemption of the gift card is subject to any terms and conditions of the issuer including those specified on the gift card.

Prize Delivery

The Giant Hookey Game- Winners will receive their prize instantly after being notified of them winning

The Draw Prize: Winners will receive their prize by email 

Notification of Winners

  1. Winners of prizes in the giant hockey game will be notified verbally at the time of playing the game. 
  2. Winners of the draw will be notified in writing by email on or by 17/09/24 that is within 7 days after drawing the winner(s).The names of winners will be published on 06/09/24 on [https://donkrcfoodservice.com.au/fine-food

FURTHER DETAILS

  1. Entries must be received by the Promoter during the Promotional Period. Entries are deemed to have been received at the time of receipt into the promotion database and not at the time of transmission by the entrant. It is each entrant’s responsibility to provide current and accurate information at the time of entry. The Promoter will not be responsible for any incorrect information, including invalid postal address provided by an entrant. The Promoter will only deliver prizes to the postal address provided at entry and will not be responsible for or liable to organise re-delivery of any prize. 
  2. The Promoter reserves the right, at any time: (a) to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence); and (b) to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. The Promoter’s decision is final and no correspondence will be entered into. The Promoter reserves the right to cancel, terminate, modify or suspend the promotion or amend these terms and conditions, subject to any directions from a regulatory authority.
  3. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 
  4. The Promoter will make reasonable efforts to identify and contact the winners. Should an entrant’s contact details change during the Promotional Period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided as part of the redemption of a prize should be directed to the Promoter. If for any reason a winner does not take or redeem a prize by the time stipulated by the Promoter, then the prize will be forfeited. 
  5. The Promoter shall not be liable for any loss, damage or injury suffered or sustained (even if caused by negligence) as a result of accepting and/or using a prize or in relation to the competition, except for any liability which cannot be excluded by law. 
  6. If a prize (or a part of a prize) is unavailable for any reason, the Promoter reserves the right to substitute another prize of equal or greater value for that prize subject to the approval of any relevant body, where required. Prizes are not transferable or exchangeable and cannot be taken as cash, unless specified otherwise by the Promoter. All expenses incurred as a consequence of receiving the prize are the sole responsibility of the winner.
  7. The Promoter reserves the right to withdraw a prize if there are no eligible entrants to receive it. The Promoter reserves the right to withdraw a prize if despite the Promoter’s reasonable efforts to do so, the Promoter is not able to identify, contact or locate the winner for a period of 3 months after the draw; or a prize remains unclaimed for a period of 3 months after the draw. The Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to the prize. 
  8. Entrants consent to the Promoter using their name, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter. 
  9. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. Any cost associated with accessing the promotion, including the Website, is the entrant’s responsibility and is dependent on the Internet service provider used.
  10. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to approval by the relevant regulatory authorities, to modify, suspend, terminate or cancel the promotion, as appropriate. 
  11. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. If in the conduct of this competition, the Promoter is liable for breach of the Non-Excludable Guarantees, the Promoter’s liability is limited, to the extent permitted by law, to the cost of replacement of any benefit or prize won.
  12. Any prize supplied by a third party supplier is subject to the terms and conditions of that third party supplier. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of any third party supplier or otherwise as a result of the winner accepting and/or using a prize (even if caused by negligence), except for any liability which cannot be excluded by law. Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify the Non-Excludable Guarantees.
  13. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
  14. The Promoter collects personal information (“PI“) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.gwf.com.au/privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles (“APPs”) or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy), and cannot guarantee that any overseas recipient will not breach the APPs. By entering the promotion entrants consent to the overseas transfer on these terms as permitted by the APPs and agree that the Promoter is not liable in this regard. 
  15. Entrants confirm and promise that their entry is original and does not infringe the intellectual property rights of any third party. Entrants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and licence to use and modify their entry (including but not limited to amending, editing, selecting, cropping, retouching, adding to or deleting from any part of the submitted entry) for the purposes of George Weston Foods Limited’s business including for promotional purposes without payment. If requested, the entrant agrees to sign any further documentation required to give effect to this arrangement. To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry. Entrants agree to indemnify the Promoter, its associated agencies against all losses, damages, claims and costs by third parties arising out of, connected to or resulting from a breach of the warranty set out in this condition.
